You will read through a fun court case and then answer a few questions and challenges. The first person to answer all the questions will be rewarded a prize, which is a MYSTERY. We will have a 1st, 2nd, and 3rd place. The first place will be rewarded the prize, but the 1st, 2nd, and 3rd place will be announced at our next meeting AND on our website. So tune into the game and have fun with us. Please note: Everybody can play, but after 8:00 PM you will not be eligible for the prize. If you have any questions please let me know! It is time to take a leap back into history as we welcome the New Year in just a couple of weeks. The United States was not built in a day and neither was the laws and regulations. Today, will discuss a huge Landmark Court Case, that will not only allow you to win a prize, but will help you in a future debate. Today our blog game will be on: Gideon Vs. Wainwright Please you the link provided above to gain some extra knowledge on the topic. http://www.infoplease.com/cgi-bin/id/A0820782 Here is a little bit of history surrounding the Gideon vs. Wainwright case. – Clarence Earl Gideon was arrested after breaking into a poolroom and trying to steal something, but was caught and processed as a misdemeanor offense. Later on, Gideon appeared in court for his wrong-doing and since he could not afford an attorney he asked for one to be appointed to him. But according to the Florida state law, “an attorney may only be appointed to an indigent defendant in capital cases” and the court refused to appoint him an attorney. Representing himself, Gideon lost the court case and was sentenced to 5 years in Prison. Gideon filed a Habeas Corpus to the Florida Supreme Court and stated that the trail court violated his constitutional right, under the sixth amendment. The Supreme Court denied the Habeas Corpus, saying that this was not a capital case. After being denied the Habeas Corpus Gideon appealed to the United States Supreme Court. After a long wait, the justices voted unanimously 9-0 ruling in favor of Gideon. The Supreme court ruled that Gideon’s sixth amendment was violated and stated “that the Constitution requires the states to provide defense attorneys to criminal defendants charged with serious offenses who cannot afford lawyers themselves”. The sixth Amendment: In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense. Now that you know a little about the famous Gideon vs. Wainwright case. I am going to give you 12 questions. Eight of them will be from the text above and three you will have to find out all on your own. Don’t worry you have three hours to find the answer, but remember the sooner you get them in the closer you are to getting the MYSTERY prize. The last question will be your own opinion, BUT you will have to explain.
