CITY OF PATERSON- Jeffery Heffernan, a police officer in Paterson, New Jersey, had a mother who was bedridden and asked him to pick up a sign from a mayoral candidate’s campaign office that she wanted to put in her yard to replace a stolen one. The candidate was the opposition to the incumbent mayor, who had appointed the current police chief, Heffernan’s supervisor. Other members of the police force saw him holding the sign, talking to campaign workers, and this information spread throughout the police force by the end of that working day. The next day, as a way of punishing Heffernan for his “overt involvement” in the opposition candidate’s campaign, he was demoted from patrol officer to a “walking post”. Heffernan filed a Federal Court lawsuit alleging that he was demoted due to engaging in conduct that constituted protected speech and that, therefore, he had been deprived of a right secured by the Constitution. The question before the Supreme Court therefore was whether the First Amendment prohibited the government from demoting a public employee based on the perception that the employee supported a political candidate. GIDEON VS. WAINWRIGHT- In June 1961, a burglary occurred at the Bay Harbor Pool Room in Panama City, FL. Police arrested Clarence Earl Gideon after he was found nearby with a pint of wine and some change in his pockets. Gideon, who could not afford a lawyer, asked a Florida Circuit Court judge to appoint one for him arguing that the Sixth Amendment entitles everyone to a lawyer. The judge denied his request and Gideon was left to represent himself. He did a poor job of defending himself and was found guilty of breaking and entering and petty larceny. While serving his sentence in a Florida state prison, Gideon began studying law, which reaffirmed his belief his rights were violated when the Florida Circuit Court refused his request for counsel. From his prison cell, he handwrote a petition asking the U.S. Supreme Court to hear his case and it agreed. The Court unanimously ruled in Gideon’s favor, stating that the Six Amendment requires state courts to provide attorneys for criminal defendants who cannot otherwise afford counsel. TINKER VS. DES MOINES- John and Mary Beth Tinker of Des Moines, Iowa, wore black armbands to their public school as a symbol of protest against American involvement in the Vietnam War. When school authorities asked that the Tinkers remove their armbands, they refused and were subsequently suspended. The Supreme Court decided that the Tinkers had the right to wear the armbands, with Justice Abe Fortas stating that no one expects students to “shed their constitutional rights to freedom of speech or expression at the schoolhouse gate.” (Link can also be found on "POLLING" tab on main website)

AMAZING DEBATE! Speech and Debate had such a wonderful time of the 25th learning and discussing cross-examination. We used a old child hood favorite "Three Little Pigs" to learn vocabulary, routine, and to see if the wolf was truly guilty. CONGRATULATIONS TO: BRYANNA WATTS AND KATHERINE MEIKLE! They took the road less traveled and fought to bring the wolf to freedom! THE WOLF WAS FOUND NOT GUILTY!!! This Debate was to prepare our members for the BIG cross-examination debate on February 9th at 7:00 PM. With so many rebuttals, issues on human rights, and health, we were able to gain more knowledge on such a important topic! But now it is time to see who won!
